In accordance with Article 37 GDPR, we are not obliged to appoint a data protection officer. Nevertheless, we ensure compliance with the statutory provisions. If you wish to exercise any of the rights listed below or have any questions about data protection, simply write to us at mail@off-the-path.com.
2 What exactly is personal data?
Personal data is information that can be used to find out personal or factual circumstances about you. Information that we cannot (or only with a disproportionate effort) relate to your person, e.g. by pseudonymizing or anonymizing the information, is not personal data.
3 What data do we collect and process?
As soon as you call up our website or our website is called up by an automated system, a series of general data and information is collected, which is stored in the server log files. This includes the following data and information:
- the date and time of access to our website
- the Internet Protocol address (IP address) of the requesting computer
- the Internet service provider of the accessing system
- the browser types and versions used
- the operating system used by the accessing system
- the website from which an accessing system reaches our website (so-called referrer)
- the sub-websites that are accessed via an accessing system on our website
- and other similar data and information used for security purposes in the event of attacks on our information technology systems
When using this general data and information, no personal evaluation takes place, i.e. we do not draw any conclusions about you or your person. Rather, we use this information to improve our website and its content as well as the advertising for it, to ensure the long-term functionality of our information technology systems and the technology of our website and to provide law enforcement authorities with the information necessary for prosecution in the event of a cyber attack.
Therefore, this anonymously collected data and information is evaluated statistically and also with the aim of increasing data protection and data security in our company in order to ensure an optimal level of protection for the personal data processed by us.
This anonymous data and information from the server log files is also stored separately from all personal data provided by you.
SSL encryption
Our website uses SSL encryption (Secure Socket Layer) for the transmission of data from your browser to our server and to servers that provide files that we embed on our website. With SSL, data is transmitted in encrypted form. The data cannot be changed and the sender can be identified. You can recognize the presence of SSL encryption by the text “https” in front of the address of the website that you call up in the browser.
- data deletion and storage duration
Your personal data will be deleted or blocked as soon as the purpose of storage no longer applies or if this has been provided for by the European legislator or another legislator in laws or regulations to which we as a company are subject. The data will also be blocked or erased if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfillment of a contract.
- disclosure of data
Your personal data will not be transferred to third parties for purposes other than those listed below.
We only pass on your personal data to third parties if:
- you have given your express consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR,
- the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR is necessary to safeguard our legitimate interests or the legitimate interests of third parties and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
- in the event that there is a legal obligation for disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR and
- this is legally permissible and necessary for the processing of contractual relationships with you in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR.
- cookies
Like many websites and servers, we also use cookies on all our websites. Cookies are text files that are placed and stored on a computer system via an Internet browser. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier for the cookie. It consists of a string of characters that can be used to assign websites and servers to the specific internet browser in which the cookie was stored. This enables the websites and servers visited to distinguish the individual browser of the data subject from other Internet browsers that contain other cookies. In this way, a specific Internet browser can be recognized and identified via the unique cookie ID. By using cookies, we can optimize information and offers on our website in your interest and thus provide you as a user of our website with even more user-friendly services that would not be possible without the setting of cookies.
As already mentioned, cookies enable us to recognize the users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to re-enter their access data each time they visit the website because this is taken over by the website and the cookie stored on the user’s computer system. Another example is the cookie for a shopping basket in an online store. The online store remembers the items that a customer has placed in the virtual shopping cart via a cookie.
If you wish, you can prevent the setting of cookies by our website at any time by means of a corresponding setting of the Internet browser used and thus permanently object to the setting of cookies. You can also delete cookies that have already been set at any time via an Internet browser or other software programs. This is possible in all common Internet browsers. If you actually deactivate the setting of cookies in the Internet browser used , not all functions of our website may be fully usable.
- contact form
You have the option of contacting us via a contact form on our website. In this case, we collect your first name and email address and, if applicable, your surname, address and telephone number in order to contact you and provide the relevant services. The personal data you enter is collected and stored exclusively for internal use and for our own purposes. This data will not be passed on to third parties unless there is a legal obligation to pass it on or it serves the purpose of criminal or legal prosecution.
However, if you order products via our website, for example, this data may be passed on to one or more processors, such as a parcel service provider, who will also use the personal data exclusively for internal use attributable to the controller.
Any further use of personal data will not take place or will only take place with your prior consent. Personal data is deleted as soon as it is no longer required for the purpose for which it was stored.
- comment function on our website
You also have the option of posting comments on our website, for example under posts. In addition to your comment, we also store information about the time your comment was created, your e-mail address and, if you are not posting anonymously, your chosen user name.
Subscribe to comments
As a user of our website, you can also subscribe to comments after registering. To do this, you will receive a confirmation email with which we check whether you are actually the owner of the email address provided. However, you can unsubscribe from this function at any time via a link in our newsletter.
9th Newsletter
Notes on the newsletter and consent
The following information explains the content of our newsletter, the registration, dispatch and statistical evaluation process and your rights of objection. By subscribing to our newsletter, you agree to receive it and to the procedures described.
Use of the mailing service providers MailChimp and ActiveCampaign
Our newsletter subscribers are collected and our newsletters are sent using MailChimp and ActiveCampaign. MailChimp is a newsletter distribution platform of the US provider Rocket Science Group, LLC, based at 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, United States. ActiveCampaign, LLC, is also a newsletter distribution platform based at 1 N Dearborn, 5th Floor, Chicago, IL 60601, United States.
The email addresses of our newsletter recipients, as well as their other data described in this notice, are stored on the servers of MailChimp and ActiveCampaign in the United States.
MailChimp and ActiveCampaign use this information to send and evaluate the newsletter on our behalf. Furthermore, MailChimp and ActiveCampaign may, according to their own information, use this data to optimize or improve their own services, e.g. for the technical optimization of the dispatch and presentation of the newsletter or for economic purposes in order to determine from which countries the recipients come. However, MailChimp and ActiveCampaign do not use the data of our newsletter recipients to write to them themselves or pass it on to third parties.
We trust in the reliability and IT and data security of MailChimp and ActiveCampaign. Both companies are certified under the US-EU data protection agreement “Privacy Shield” and are therefore committed to complying with EU data protection regulations.
Furthermore, we have concluded a so-called “Data Processing Agreement” with both MailChimp and ActiveCampaign. This is a contract in which the companies undertake to protect the data of our users, to process it on our behalf in accordance with their data protection regulations and, in particular, not to pass it on to third parties. You can view the privacy policies of both companies under the following links
MailChimp: https://mailchimp.com/legal/privacy/
ActiveCampaign: https://www.activecampaign.com/privacy-policy/
Content of the newsletter
We only send newsletters, emails and other electronic notifications with advertising information (hereinafter “newsletter”) with the consent of the recipient or with legal permission. If the contents of the newsletter are specifically described when registering for the newsletter, they are decisive for the user’s consent.
Above all, our newsletters should be fun and offer added value. In particular, we send out information on travel and outdoor topics, but also information that is relevant to equestrian sports (including references to articles, advertisements, white papers or online presences).
Double opt-in and logging
The registration for our newsletter takes place in a so-called double opt-in procedure. This means that after registering you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that no-one can register with other people’s e-mail addresses.
Subscriptions to the newsletter are logged in order to be able to prove the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation as well as the IP address. Changes to your data stored by MailChimp and ActiveCampaign are also logged.
Login data
To subscribe to our newsletter, all you need to do is enter your e-mail address.
To receive even more personalized newsletters from us, you can also enter your first and last name and, if applicable, your date of birth, your gender and the name and age of your horse. We only use this information to better tailor the content of the newsletter to your interests. In exceptional cases, e.g. for certain promotions, we also ask for your address to enable us to send you the newsletter. The addresses generated in this way are only used for the respective campaign and are not used for any other purpose.
Statistical survey and analyses
The newsletters contain a so-called “web-beacon”, i.e. a pixel-sized file that is retrieved from the MailChimp and ActiveCampaign servers when the newsletter is opened. As part of this retrieval, technical information, such as information about your browser and your system, as well as your IP address and the time of your retrieval are initially collected. This information is used for the technical improvement of the services based on the technical data or the target groups and reading behavior based on their retrieval locations (which can be determined with the help of the IP address) or the access times.
The statistical surveys also include determining whether and when the newsletters are opened and which links are clicked on. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is not our intention, nor that of MailChimp or ActiveCampaign, to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.
Online access and data management
There are cases in which we direct newsletter recipients to the websites of MailChimp or ActiveCampaign. For example, our newsletters contain a link that newsletter recipients can use to access the newsletter online (e.g. in the event of display problems in the email program). Newsletter recipients can also correct their data, such as their e-mail address, at a later date. The privacy policies of MailChimp and ActiveCampaign are also only available on their websites.
We would also like to draw your attention to the fact that cookies are also used on the MailChimp and ActiveCampaign websites and that personal data is therefore processed by MailChimp and ActiveCampaign and their partners and service providers (such as Google Analytics). We have no influence on this data collection. You can find more information on this in the privacy policies of MailChimp and ActiveCampaign.
How to cancel/revoke your subscription to the newsletter
You can unsubscribe from our newsletter at any time, i.e. revoke your consent. At the same time, your consent to receive the newsletter via MailChimp and ActiveCampaign and to the statistical analyses will expire. It is not possible to separately withdraw your consent to sending via MailChimp and ActiveCampaign or to the statistical analysis.
You will find a link to unsubscribe from the newsletter at the end of each newsletter.
Legal basis of the General Data Protection Regulation
In accordance with the provisions of the General Data Protection Regulation (GDPR) applicable from May 25, 2018, we inform you that the consent to the sending of e-mail addresses is based on Art. 6 para. 1 lit. a, 7 GDPR and § 7 para. 2 no. 3 and para. 3 UWG. The use of the mailing service providers MailChimp and ActiveCampaign, the implementation of statistical surveys and analyses as well as the logging of the registration process are based on our legitimate interests in accordance with Art. 6 para. 1 lit. f GDPR. We are interested in the use of a user-friendly and secure newsletter system that serves both our business interests and the expectations of users.
We would also like to point out that you can object to the future processing of your personal data at any time in accordance with the legal requirements pursuant to Art. 21 GDPR. In particular, you may object to processing for direct marketing purposes.
- external tools
Use of Google Analytics
We use Google Analytics on our website, a web analysis service provided by Google Inc (“Google”). Google Analytics uses cookies, which, as already mentioned, are text files that are stored on your computer and enable your use of the website to be analyzed. The information generated by the cookie about your use of our website (including your IP address, which is anonymized using the _anonymizeIp() method so that you can no longer be assigned to a connection) is transmitted to a Google server in the USA and stored there. Google will use this information for the purpose of evaluating your use of our website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. As already explained, you can prevent the installation of cookies by setting your browser software accordingly. However, we would like to point out once again that in this case you may not be able to use all the functions of our website to their full extent. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.
You can object to the collection of data by Google Analytics with effect for the future by installing a deactivation add-on for your browser.
Google Remarketing
Furthermore, our website uses the remarketing function of Google Inc (“Google”). This function is used to present interest-based advertisements to visitors to our website as part of the Google advertising network. Here, too, your browser stores so-called “cookies”, text files that are stored on your computer and make it possible to recognize you as a visitor when you visit our website. Incidentally, this applies to all pages that belong to the Google advertising network. On these pages, the visitor can then be presented with advertisements that relate to content that the visitor has previously accessed on websites that use Google’s remarketing function. According to Google, it does not collect any personal data during this process. However, if you do not wish to use Google’s remarketing function, you can deactivate it by making the appropriate settings atwww.google.com/settings/ads . Alternatively, you can deactivate the use of cookies for interest-based advertising via the advertising network initiative by following the instructions at http://www.networkadvertising.org/managing/opt_out.asp. Further information on Google Remarketing and Google’s privacy policy can be found here: http://www.google.com/privacy/ads/.

The plugins can be recognized by one of the Facebook logos (white “f” on a blue tile or a “thumbs up” sign) or by the addition “Facebook Social Plugin”. You can view the list and appearance of the Facebook social plugins here: http://developers.facebook.com/.
When you visit our website, your browser establishes a direct connection with the Facebook servers. The content of the plugin is transmitted by Facebook directly to your browser, which integrates it into the website. We therefore have no influence on the scope of the data that Facebook collects with the help of this plugin and therefore inform you according to our level of knowledge:
By integrating the plugins, Facebook receives the information that you have visited our website. If you are logged in to Facebook, Facebook can assign the visit to your Facebook account. If you use the plugins, for example by clicking the Like button or posting a comment, the corresponding information is transmitted directly from your browser to Facebook and stored there. If you are not a member of Facebook, it is still possible for Facebook to find out your IP address and store it.
The purpose and scope of the data collection and the further processing and use of the data by Facebook as well as your rights in this regard and setting options to protect your privacy can be found in Facebook’s data protection information: http://www.facebook.com/policy.php.
If you are a Facebook member and do not want Facebook to collect data about you via our website and link it to your membership data stored on Facebook, you must log out of Facebook before visiting our website.
You also have the option of blocking Facebook social plugins with add-ons for your browser, for example with the “Facebook Blocker”.
Use of Facebook Custom Audience
Remarketing tags from the social network Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA are integrated on our website. When you visit our website, a direct connection is established between your browser and the Facebook server via the remarketing tags. Facebook receives the information that you have visited our website with your IP address. This allows Facebook to associate your visit to our website with your user account. We can use the information obtained in this way to display Facebook ads.
We would like to point out that, as the operator of the website, we have no knowledge of the content of the transmitted data or its use by Facebook. You can find more information on this in Facebook’s privacy policy (www.facebook.com/about/privacy/ ). If you do not wish data to be collected via Custom Audience, you can deactivate Custom Audiences here (www.facebook.com/ads/website_custom_audiences/ ).
